This service is provided to you by Hyarchis Company Ltd (“Hyarchis”). Your access to all services provided by Hyarchis (“the Services”) is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document (known collectively as "Terms of Use"). Your use of, and/or access to all the Services constitutes your agreement to the Terms of Use. Hyarchis reserves the right to amend the Terms of Use at any time. Since you are bound by these Terms of Use, you should ensure that you have read and fully understood them.

Your telephone carrier supplies the carriage for the Chat & Picture Services to you. (NOTE: The first password is a FREE message sent to you) The charges for the carriage of all Services will appear on your next mobile telephone bill. All queries relating to mobile telephone bills should be directed to your mobile telephone carrier. Charges for specific Services are set out below.

Under no circumstances (including but not limited to any act or omission on the part of Hyarchis) will Hyarchis be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access the Services. You agree to opt in to marketing lists. Terms can change without notice.

By entering your mobile number in any of the "enter mobile number" fields and ticking off the Terms&Conditions, you confirm that you have read and understood the T&C, and furthermore agree that (a) your mobile number can be used for further marketing purposes by Hyarchis alone, (b) you are at least 18 years of age and (c) to subscribe to the Babe of the Day sent to your mobile phone (BoD) at the picture service rates described below but which subscription can be terminated by you at any time by sending the word "STOP" to 1998 8998.

Except as provided for by any non-excludable statutory right:
a) all content for the Services are provided "as is" and without warranties of any kind, either express or implied,
b) Your mobile telephone carrier, Hyarchis and its suppliers expressly disclaim all warranties of any kind including but not limited to implied warranties of merchantability and fitness for a particular purpose,
c) Neither your mobile telephone carrier, Hyarchis warrants that access to the Services will be available, uninterrupted, free from delay or error-free or that any defects will be corrected. Your mobile telephone carrier or Hyarchis may terminate or discontinue in whole or in part any or all of the Services at any time, for any reason.
d) You are solely responsible for the Content that you publish or display (hereinafter, "post") on the Service, or transmit to other Members.
e) You must use the Service in a manner consistent with any and all applicable laws and regulations.
f) You may not include in your Member profile any telephone numbers, street addresses, last names, URLs or email addresses.
g) You may not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. You may not transmit any chain letters or junk email to other Members. Although Hyarchis cannot monitor the conduct of its Members off the Website, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect our Members from such advertising or solicitation, Hyarchis reserves the right to restrict the number of emails which a Member may send to other Members in any 24-hour period to a number which Hyarchis deems appropriate in its sole discretion.
h) All information, text, material, graphics, software and advertisements contained in or forming the Services ("Content") are the property of Hyarchis, its suppliers and/or licensors (including your mobile telephone carrier) unless expressly indicated otherwise. The Content is protected by Australian and international copyright and trademark laws. You must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute this Content in any way.
i) Hyarchis is open to customers who are connected to the Telstra, Vodafone, Optus, Orange, 3, Virgin mobile digital networks and participating service providers with Text messaging compatible mobile phones.

Use of Hyarchis (19 7777 40): This dating service is charged at $4/message pair. To quit send the word STOP to 19 7777 40.

Use of Hyarchis BoD (1998 8998): The BoD service is $4 per pic/message received. Daily member alerts. To quit send the word STOP to 1998 8998. Service not availalbe on Virign and Hutchinson.

Use of Hyarchis BoD (19966660): The BoD service is $4 per pic/message received. Daily member alerts. To quit send the word STOP to 19966660. Service not availalbe on Virign and Hutchinson.

Additional Terms & Conditions: 3/Hutchinson/Orange users can not receive content messages.

Customers must not use Hyarchis or generate Hyarchis content:
(a) with the intention or result that another person is menaced or harassed; or
(b) that would be regarded by reasonable persons as being, in all the circumstances, offensive; or
(c) that is indecent, obscene, abusive, threatening, defamatory or incites hatred to any person or groups; or
(d) having regard to any reference in the content to matters of drug misuse or addiction, crime, cruelty, violence, revolting or abhorrent phenomena or obscene language; or
(e) that interferes with the enjoyment of an Hyarchis session by other Customers;
(f) that breaches any laws
(g) infringes a third party's rights (including Intellectual Property Rights and copyright); or
(h) that advertises products or services.
